Please read these Terms and Conditions carefully and accept before purchasing any item/service/policy featured on the Marketplace in specter.pk. By using the Site or its related sub-domains, sites, mobile app, services and tools, you hereby accept these terms and conditions and represent that you agree to comply with these terms and conditions. By accessing or using the site, service and Software you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access, register with or use this Site & related services.
Accessing the Website & Account Security
Intellectual Property Rights
The website and its entire contents, features and functionality (including but not limited to all information, software, text, displays, images, video and audio, and the design, selection and arrangement thereof), are owned by the Company, its licensors or other providers of such material and are protected by copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws. These Terms & Conditions permit you to use the website for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store or transmit any of the material on our website, except as follows:
- Your electronic mobile device may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.
- You may store files that are automatically cached by your browser for display enhancement purposes.
- If we provide social media features with certain content, you may take such actions as are enabled by such features.
You must not:
- Modify copies of any materials from the website.
- Use any illustrations, photographs, video or audio sequences or any graphics separately from the accompanying text.
- Delete or alter any copyright, trademark or other proprietary rights notices from copies of materials from the website.
You must not access or use for any commercial purposes any part of the website or any services or materials available through the website. If you wish to make any use of material on the website other than that set out in this section, please address your request to email@example.com If you print, copy, modify, download or otherwise use or provide any other person with access to any part of the website in breach of the Terms & Conditions, your right to use the website will cease immediately and you must, at our option, return or destroy any copies of the materials you have made. No right, title or interest in or to the website or any content on the website is transferred to you, and all rights not expressly granted are reserved by the Company. Any use of the website not expressly permitted by these Terms & Conditions is a breach of these Terms & Conditions and may violate copyright, trademark and other laws.
Specter.pk attempts to be as accurate as possible. However, specter.pk does not warrant that product descriptions or other content of any Marketplace product/service is accurate, complete, reliable, current, or error-free, neither specter.pk assumes any liability for any difference in the product description and the actual product.
Packaging, Shipping Rates and Policies
Packaging is the sole responsibility of the merchant and specter.pk is sole responsible for the shipping and delivery or return of the product. The final price paid from the specter.pk account will include packaging, shipping and delivery charges, based on the Customer’s location. The Customer should be aware that merchants might be able to make changes to an order if they have not yet shipped it, but some merchants begin processing orders almost as soon as they are placed. If the Customer wants to change or cancel order, he/she should contact the specter.pk helpline +92-3-111-555-100 immediately, as such requests will not be processed after the order has been confirmed. Specter.pk team will take up the matter with concern vendor if the request is received within the accepted time. The decision of reversal or cancelation order will be on the discretion of vendor/merchant. Specter.pk itself cannot cancel or change an order on the Customer’s behalf and will not refund for shipping charges.
Risk of Loss
All purchases of physical items from the specter.pk are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to the Customer upon delivery to the carrier. The Customer is also responsible for ensuring the product is undamaged in case he/she wants to return it.
Pricing, Availability & Order Processing
All prices are listed in Rupees and are inclusive of GST and are listed on the Site by the seller that is selling the product or service. Items in your Shopping Cart will always reflect the most recent price displayed on the item's product detail page. Please note that this price may differ from the price shown for the item when you first placed it in your cart. Placing an item in your cart does not reserve the price shown at that time. It is also possible that an item's price may decrease between the time you place it in your basket and the time you purchase it. We do not offer price matching for any items sold by any seller on our Site or other websites. We are determined to provide the most accurate pricing information on the Site to our users; however, errors may still occur, such as cases when the price of an item is not displayed correctly on the Site. As such, we reserve the right to refuse or cancel any order. In the event that an item is mispriced, we may, at our own discretion, either contact you for instructions or cancel your order and notify you of such cancellation. We shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your prepayment processed. If such a cancellation occurs on your prepaid order, our policies for refund will apply. We list availability of the information for products listed on the Site, including on each product information page. Beyond what we say on that page or otherwise on the Site, we cannot be more specific about availability. Please note that there are cases when an order cannot be processed for various reasons. The Site reserves the right to refuse or cancel any order for any reason at any given time. You may be asked to provide additional verifications or information, including but not limited to phone number and address, before we accept the order.
In order to avoid any fraud with credit or debit cards, we reserve the right to obtain validation of your payment details before providing you with the product and to verify the personal information you shared with us. This verification can take the shape of an identity, place of residence, or banking information check. The absence of an answer following such an inquiry will automatically cause the cancellation of the order within a reasonable timeline. We reserve the right to proceed to direct cancellation of an order for which we suspect a risk of fraudulent use of banking instruments or other reasons without prior notice or any subsequent legal liability.
The Customer can submit disputes/complaints from within specter.pk. If he/she wishes, an email can be sent directly to firstname.lastname@example.org or a call be placed to +92-3-111-555-100. The comments will be considered carefully and a response will be given in 7 business days. Customer’s complaint will be fully resolved within 15 business days of date of receipt. The Customer can raise a dispute/complaint within 7 days of submitting payment. Any dispute or claim relating in any way to the use of any products or services sold or distributed by specter.pk will be resolved by referring to the Merchant Agreement. The dispute, if any will be handled by the merchant/seller as per its customer complaint policy and will be between the merchant/seller and the customer. The laws of Pakistan will govern the dispute between the merchant /seller and the customer. Specter.pk in no event will be liable to refund or return any amount. In case a complaint is received when any applicable tax is deposited to concerned authorities, the Customer will bear the applicable tax charge. In case a complaint is received when applicable tax is with the specter.pk or the merchant, same will be refunded to the Customer. Cases of Dispute The item was materially different: Customer should wait 14 business days for the delivery of tangible items or services before filing a complaint. However, a complaint needs to be submitted within 7 days of making payment. If a merchant has clearly misrepresented the condition or details of an item in a way that affects its value or utility, it is "materially different" and that merchant should be willing to offer a refund or exchange within 14 days of shipment. If the merchant does not accept the return of an item that is made in accordance with the Merchant's Return Policy in the Merchant Agreement, the Customer may qualify for a refund. Items are considered "materially different" in these circumstances:
- Wrong version
- Item condition or details not as described
- Wrong item
- Missing parts or components
- Defective item
- Damaged item
When submitting a dispute within specter.pk with the reason "materially different," the Customer will need to select one of the reasons above and provide comments explaining why the item received is materially different from the item purchased. The payment was debited from specter.pk but order was not confirmed: Customer must immediately report the dispute from within specter.pk. As part of the dispute resolution process, Marketplace Operations will contact both parties in the transaction. If it is determined that the Customer is not responsible for the problem, he/she will be reimbursed exclusive of applicable taxes. In case customer lodged complaint when applicable taxes is deposited to concerned authorities, the Customer will bear the applicable tax charge. In case customer lodged the complaint when applicable tax is with the specter.pk or merchant, same will be refunded to the Customer. Although Marketplace Operations will try to complete the investigation as soon as possible, it can take up to 15 business days before reaching a conclusion. During this time, the Customer might be contacted to obtain additional information about the situation. Merchant does not cooperate in case of a dispute: Any merchant that fails to cooperate in good faith to resolve a Customer's complaint may have its account privileges restricted or terminated from the Marketplace. Marketplace Operations Team also expects merchants to respond to email correspondence concerning complaints against them within 7 days. Finally, future sales’ payment will be put on hold in a merchant's account if the merchant does not respond timely to a dispute or does not honour a commitment made to resolve a dispute within a reasonable amount of time. Requirements to Submit a Dispute
- The dispute must be timely submitted.
- The reason must be clearly mentioned.
- The required information on the dispute form must be provided.
- If the error is proven to be due to the Customer’s behavior, no refund or coverage will be given to the Customer.
